Man Pleads Guilty to Criminal Neglect of Mother

A Nampa man pleaded guilty to charges of neglect and faces up to ten years in prison.  The plea was made on the day his second trial for this crime was scheduled to begin.  The first trial ended in a mistrial.  The man's attorney is planning to appeal the conviction and is seeking to delay sentencing.

From the the Idaho Statesman:

Danny Nicks, 56, agreed to a deal aimed at pairing his case with his identical twin’s conviction on the same charge.

He made the plea Wednesday, the day his second jury trial had been scheduled to begin. His first jury deadlocked in May.

Defense attorneys aim to appeal both convictions and hope to get both judges to sentence the brothers but delay execution of those sentences so the twins could remain free until after the appeal has been resolved.

Neither judge has yet agreed to suspend execution of the sentences, which could call for up to 10 years in prison. If Judge Dennis Goff decides not to stay Danny Nicks’ sentence, the defendant will be able to withdraw his guilty plea and face another jury trial.

Goff sent a sentencing date of 1:30 p.m. Aug. 27 for Danny Nicks. His twin David, found guilty by a jury in May, is scheduled for sentencing July 22 by Judge James Morfitt.

The brothers were arrested in December, about a month after emergency workers removed their mother from her longtime Nampa home, where she was found emaciated and immobile with severe bedsores in a bed covered in feces, urine and flies.
